Privacy Policy

At Ãnu Travel, Inc., your privacy is important to us. This Privacy Policy is designed to explain how we collect, use, and disclose information in connection with our website (www.flyanu.com), email messages, and mobile app that link to this Privacy Policy (collectively, the “Services”). The terms “FlyÃnu,” “we,” and “us” include Ãnu Travel, Inc. and our affiliates and subsidiaries. By using the Services, you agree to the terms and conditions of this Privacy Policy.

Information We Collect

Personal Information You Provide Us

When you sign up to receive email updates or register for an account as a user and member of the FlyÃnu community, we collect information from or about you such as:

  • Name;
  • Telephone number;
  • Email address; and
  • Any other information you choose to submit in connection with your profile, such as your date of birth, weight, gender, address, profile photo, and emergency contact information.

If you are registering as a pilot, we may collect additional information through our web form and onboarding process, such as your government I.D., FAA issued certificate number, and flight experience.

If you book a guest for a flight other than yourself, including for a minor, we may ask you to provide information about them to complete the booking, including their name, weight, gender, date of birth, email address, and emergency contact information. By booking a flight for another person, you represent that you have the consent of that person to provide information about them to us.

We use a third-party payment service to process payments made through the Services. If you make a payment through the Services, your credit or debit card information may be collected by such third party and not by us, and will be subject to the third party’s Privacy Policy, rather than this Privacy Policy. We have no control over, and are not responsible for, this third party’s collection, use, and disclosure of your Personal Information.

If you contact us directly, we may receive additional information about you. For example, when you contact us for support, we will receive your name, email address, phone number, the contents of your message or attachments that you may send to us, and other information you choose to provide.

Information We Collect Automatically From Your Use of the Services

When you use our Services, if you allow us, we will collect information about your precise geolocation. We also infer your more general location information (for example, your IP address may indicate your more general geographic region).

 When you use our Services, we and our third party service providers may collect information from you through automated means, such as cookies, web beacons, and web server logs. Our third party partners, such as analytics and advertising partners, may use these technologies to collect information about your online activities over time and across different services. Cookies are small text files containing a string of alphanumeric characters. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to our Services.

 The information collected in this manner includes IP address, browser characteristics, device IDs and characteristics, operating system version, language preferences, referring URLs, and information about the usage of our Services, such as the pages you view and the dates and times of your visits.

We use Google Analytics, which uses cookies and similar technologies to collect and analyze information about use of the Services and report on activities and trends. This service may also collect information regarding the use of other websites, apps and online resources. You can learn about Google’s practices by going to https://www.google.com/policies/privacy/partners/, and opt out of them by downloading the Google Analytics opt-out browser add-on, available at https://tools.google.com/dlpage/gaoptout.

If you do not want information collected through the use of cookies, there is a simple procedure in most browsers that allows you to automatically decline cookies or be given the choice of declining or accepting the transfer to your computer of a particular cookie (or cookies) from a particular site. You may also wish to refer to http://www.allaboutcookies.org/manage-cookies/index.html. If, however, you do not accept cookies, you may experience some inconvenience in your use of the Services.

There is no accepted standard on how to respond to Do Not Track signals. The Services do not respond to such signals.

Information We Receive from Third Parties

We work with third party partners to perform background checks on pilots and may receive publicly available information about you.

How We Use Your Information

We may use the information we collect:

  • To operate, maintain, enhance and provide features of the Services;
  • To communicate with you, provide information that you request, to respond to comments and questions, and otherwise to provide support to users;
  • To understand and analyze the usage trends and preferences of our users, to improve the Services, and to develop new products, services, features, and functionality;
  • To contact you for marketing purposes, such as developing and providing promotional and advertising materials that may be useful, relevant, valuable or otherwise of interest to you; To personalize your experience on the Services by presenting products and offers tailored to you;
  • To send you text messages and push notifications;
  • To facilitate transactions and payments;
  • To de-identify or aggregate data collected through the Services and use and disclose it for any lawful purpose;
  • For our business purposes, such as data analysis, audits, security, fraud monitoring and prevention; determining the effectiveness of our promotional campaigns; and operating and expanding our business activities;
  • For compliance purposes, including enforcing our Terms of Use or other legal rights, or as may be required by applicable laws and regulations or requested by any judicial process or governmental agency; and
  • For other purposes for which we provide specific notice at the tie the information is collected.

How We Share Your Information

We do not disclose the information that we collect through the Services to third parties except in the following circumstances:

  • To our affiliates for any of the purposes described in this Privacy Policy.
  • To our third party service providers who provide services such as website hosting, payment processing, data analysis, information technology and related infrastructure provision, customer service, email delivery, online advertising, auditing, and other services.
  • To a potential or actual acquirer, successor, assignee, or other third parties in connection with the consideration, negotiation, or completion of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in bankruptcy or similar proceedings).
  • If required to do so by law or in the good faith belief that such action is appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.
  • We may also disclose information from or about you or your devices with your permission.

We work with third party advertising partners to show you ads that we think may interest you. These advertising partners may set and access their own cookies, pixel tags and similar technologies on our Services and they may otherwise collect or have access to information about you which they may collect over time and across different online services. Some of our advertising partners are members of the Network Advertising Initiative (http://optout.networkadvertising.org/?c=1#!/) or the Digital Advertising Alliance (http://optout.aboutads.info/?c=2&lang=EN). If you do not wish to receive personalized ads, please visit their opt-out pages to learn about how you may opt out of receiving web-based personalized ads from member companies. You can access any settings offered by your mobile operating system to limit ad tracking, or you can install the AppChoices mobile app to learn more about how you may opt out of personalized ads in mobile apps.

We do not share your personal information with unaffiliated third parties for their own direct marketing purposes, unless we have your permission to do so.

Your Choices

You can prevent your device from sharing precise location information at any time through your device’s operating system settings.

From time to time, we send marketing messages to our users via various channels including e-mail and SMS. If you no longer want to receive such message from us on a going forward basis, you may opt-out via the “unsubscribe” functionality provided in each such message.

Third Party Services

This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third parties, including any third party operating any site or service to which the Services link. This Privacy Policy does not apply to your activities on these third party services, or any information you disclose to these third parties. The inclusion of a link on the Services does not imply endorsement of the linked site or service by us or by our affiliates. We encourage you to read their privacy policies before providing any information to them.

Security

We use certain physical, organizational, and technical safeguards that are designed to maintain the integrity and security of information that we collect. However, as our Services are hosted electronically, we can make no guarantees as to the security or privacy of such information.

Use of Services by Minors

We do not knowingly collect personal information from children under 13 years of age, and no part of our Services are directed to children. If you learn that a child has provided us with personal information in violation of this Privacy Policy, then you may alert us as described in the Contact Us section, below.

International Cross-Border Data Transfer

FlyÃnu uses servers hosted in the United States. Please note that we may be transferring your information outside of your region for storage and processing in the United States and around the globe. By using the Services, you consent to the transfer of information to countries outside of your country of residence, including the United States, which may have data protection rules that are different from those of your country.

Update Your Information or Pose a Question

You can update your account and profile information through your profile settings. If you have questions about your privacy on the Services or this privacy policy, please contact us as described in the Contact Us section, below.

Updates to This Privacy Policy

We may make changes to this Privacy Policy. The “Last Updated” legend at the top of this page indicates when this Privacy Policy was last revised. Any changes will become effective when we post the revised Privacy Policy on the Services. Your use of the Services following these changes means that you accept the revised Privacy Policy. If we materially change the ways in which we use or share personal information previously collected from or about you or your device through the Services, we will notify you through the Services, by email, or by other communication.

Deletion Request Rights

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  1.   Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  2.   Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  3.   Debug products to identify and repair errors that impair existing intended functionality.
  4.   Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  5.   Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  6.   Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  7.   Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  8.   Comply with a legal obligation.
  9.   Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by emailing us at info@flyanu.com

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account.

We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
